It seems that the teacher did have permission of the school district, as 
the teachers quote in the article indicates  *"My administration knew; I 
also got a district grant for it,"*. Unfortunately it didn't get passed 
on to the rest of the teaching staff.

The main problem was the following guideline was ignored by the teacher 
and his class.
 From GC.COM
*"Caches near, on or under public structures deemed potential or 
possible targets for terrorist attacks. These may include but are not 
limited to highway bridges, dams, government buildings, elementary and 
secondary schools, and airports."

*That's my two cents worth....
